Why are Lawyers important to a band?

In my previous post I made reference to lawyers and their importance. The funny thing is that this is often the last thing a band thinks about and the first thing that they should be thinking about.

More and more bands need to be treated like a business deal, and all great business deals benefit everyone involved.

In researching this topic further I found that there is so much to know in almost every aspect of the music industry. THATS WHEN A LAWYER COMES IN!

Entertainment Lawyers

Lawyers know all this stuff. Just like you know how to play your instrument like a guru, lawyers know the ins and outs of the legal system. IT PAYS TO GET ADVICE FROM THEM.

I spoke to Mandy Jay from Jay Inc, an entertainment law specialist, on email and got some input from her:

    "Any band should have a contract amongst the band members in order to protect each other. They might be friends starting a band, not having extensive financial means for all that might be needed, but as fame arises so does fortune grow. We all know that money is the root of all evil. The members therefore must be protected individually as well as in the band.

    A decision must be made by the band members whether the band wishes to register as a Close Corporation or a Company (Pty) Ltd etc. They can not remain as individuals. Think along the lines of tax purposes, band assets, insurance etc.
    Bands must sign proper contracts with all and everybody they deal with in order to protect the band and its members.
    SAMRU must further be contacted in order to obtain all relevant rights, licences etc."

On a personal level i have found Donald S. Passmans book "All You Need To Know About the Music Business" very informative. It covers a most of the music industry and includes legal commentary.

I like what Mandy said about having a contract. Its about protecting all the band members and not about trying to pull the wool over anyones eyes.
